Terms of Service

Mettacompany Lda, a company duly incorporated and operating under the laws of Portugal, with registered office in Lisbon and VAT number PT516915380, owns and operates the mettaCofounder.ai platform. These Terms of Service govern access to and use of the platform, including any associated websites, applications, content, tools, and services offered by Mettacompany.

By creating an account, subscribing to a plan, or otherwise using the platform, you acknowledge that you have read, understood, and agree to be bound by these terms. If you are using the platform on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these terms.

Your access to the platform is conditioned on your acceptance of and compliance with these terms. These terms apply to all visitors, users, and others who access or use the platform. You may not use the platform if you do not agree to these terms in full.

We may update these terms from time to time. Continued use of the platform after any changes constitutes acceptance of the revised terms. Material changes will be communicated via email or through the platform at least thirty days before taking effect, where required by applicable law.

mettaCofounder.ai provides an AI-assisted operating system for solo entrepreneurs and small teams, including tools for brand positioning, content generation, outreach, lead discovery, and sales enablement. The platform may integrate with third-party services such as GoHighLevel, OpenAI, Anthropic, and others.

We do not guarantee specific business outcomes, revenue growth, or number of leads generated. The platform is a tool to support your own execution, judgment, and commercial decisions.

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or present a security risk to the platform or other users.

Access to certain features requires a paid subscription. Fees are billed in advance on a monthly or annual basis, depending on the plan selected. All payments are processed through our payment processor, Stripe. Prices are stated in Euros unless otherwise indicated and do not include applicable taxes.

Subscriptions automatically renew unless cancelled before the next billing date. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period, and no refunds will be issued for partial months.

We may offer a free trial period for certain plans. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. We may request payment information at the start of the trial to facilitate this conversion.

We reserve the right to limit eligibility for free trials, including by restricting trials to new customers or specific promotional periods.

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. After that, your account will revert to a limited free tier or be suspended, depending on the plan.

Refunds are generally not provided except where required by applicable law or at our sole discretion in cases of billing errors or technical failures attributable to us.

The platform, its design, code, branding, and all original content are the property of Mettacompany Lda and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the platform without our prior written consent.

You retain ownership of any content, data, or materials you input into the platform. By using the platform, you grant us a limited license to process that content solely for the purpose of providing and improving the service.

You are solely responsible for the content you create, upload, or generate using the platform. You represent that you have all necessary rights to such content and that it does not infringe upon the rights of any third party.

We do not claim ownership over your outputs. However, we may use anonymized and aggregated usage data to train, improve, and benchmark our models and services, provided that such data does not identify you or include your confidential information.

We believe your work should remain portable. At any time during an active subscription, and for a reasonable period after cancellation, you may export your data from the platform in commonly used formats. We provide guidance on export procedures in our help documentation.

We are not responsible for data loss resulting from your failure to export content before account suspension or deletion.

Certain plans include access to a GoHighLevel sub-account provisioned and managed by Mettacompany. Use of that sub-account is subject to GoHighLevel's terms of service and acceptable use policy in addition to these terms.

We may suspend or revoke access to bundled third-party services in the event of misuse, excessive usage, or violations of the third-party provider's policies. We are not liable for downtime, data loss, or changes in functionality caused by third-party services.

The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the platform will be uninterrupted, secure, error-free, or that any outputs generated by AI features will be accurate, complete, or suitable for your specific purposes.

To the maximum extent permitted by law, Mettacompany Lda and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the platform.

Our total liability for any claim arising under these terms shall not exceed the total amount paid by you to us in the twelve months preceding the event giving rise to the liability.

These terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any dispute arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

Before initiating any legal proceedings, the parties agree to attempt in good faith to resolve the dispute informally through direct negotiation.
